In Minnesota, a federal judge issued a ruling on Friday that prohibits immigration officers in the Minneapolis area from detaining or using tear gas on peaceful protesters. This ruling, the most restrictive order to date against the numerous masked agents, came in response to the recent killing of Renee Good.
U.S. District Judge Kate Menendez granted a temporary injunction that limits when immigration agents can deploy chemical irritants in crowds. The order also bars agents from retaliating against peaceful demonstrators exercising their First Amendment rights. This practice is under scrutiny in a lawsuit by the American Civil Liberties Union against the Department of Homeland Security and Secretary Kristi Noem.
Since early December, there has been close monitoring of Immigration and Customs Enforcement and Border Patrol officers enforcing the Trump administration’s immigration crackdown in the Minneapolis-St. Paul region. While the administration claims the operation aims to address fraud allegations, protesters accuse the masked agents of violating their constitutional rights and engaging in violent retaliation.
The ruling specifically prevents officers from detaining individuals in vehicles unless there is reasonable suspicion of obstruction or interference. Judge Menendez emphasized that merely following agents at a distance does not justify a vehicle stop. The ruling also mandates that agents cannot arrest people without probable cause or reasonable suspicion of criminal activity or interference with law enforcement operations.
Government lawyers argue that officers have been acting within their legal authority to enforce immigration laws and ensure their safety. However, Minneapolis Mayor Jacob Frey criticized the surge of ICE agents, describing it as a source of chaos in the city and state.
Following the shooting of Renee Good by ICE agent Jonathan Ross, tensions escalated in the area. Good, a mother and U.S. citizen, was shot multiple times in the head as she drove away. This incident led to criticism from various political figures and demands for accountability and an end to the violent tactics used by federal agents.
In a lawsuit filed by the ACLU, federal immigration officers in Minnesota are accused of racial profiling and unlawful detentions. The lawsuit, representing three U.S. citizens, details racially motivated violations of constitutional rights and violence carried out by masked federal agents.
Videos have shown federal officers using aggressive crowd control measures, including tear gas and stun grenades, against protesters. The Intercept reported that agents have referenced Good’s death to intimidate demonstrators, linking it to the use of force in Ross’s actions.
