A judge in the United States has dismissed Elon Musk’s fraud allegations against OpenAI and co-founder Sam Altman, but will proceed to trial on the claims of breach of charitable trust and unjust enrichment. The ruling came from U.S. District Judge Yvonne Gonzalez Rogers in Oakland, California.
Jury selection is set to commence on Monday, with opening arguments expected on Tuesday.
Musk’s assertion that his fraud and constructive fraud claims should be dismissed to streamline the case and maintain focus on ensuring OpenAI’s commitment to benefiting humanity rather than solely pursuing profit was noted.
The case revolves around Musk’s contention that OpenAI, Altman, and Microsoft, one of the major investors in OpenAI, deceived him and the public by establishing a for-profit entity in 2019 after his departure from OpenAI’s board. Reports from Reuters indicate that OpenAI is gearing up for a potential initial public offering that could value the company at $1 trillion.
In the ongoing legal proceedings, Musk is reportedly seeking $150 billion in damages, with the funds intended to benefit OpenAI’s charitable endeavors.
